On the evening of Nov. 3, Dr. Penny Smith, professor of sociology at Saint Leo University, died due to the injuries that had previously lead to her comatose condition. Charges have been filed against Alicia Stumbo, Sean Betz, and Beau Franklin, the three students arrested previously in association with her case.
Each student has been charged with battery, trespassing, and criminal mischief. In addition, the students were originally charged with culpable negligence, but with the death of Smith this charge has been changed to manslaughter.
Smith was found unconscious in her office by fellow staff on the morning of Sept. 28. The incident report provided by Campus Security and Safety stated that Smith was stung by several wasps when entering her office and as a result, stumbled, fell, and hit her head.
The crime scene report indicated the incident as a burglary. According to the incident report the unknown subjects of the investigation had broken into the office through the window on the east side of the office. They went through the window into the office, and knocked over various chairs and papers, putting the office into a state of disarray. In addition, a clock was broken and the numbers “1621201” were written on one of Smith’s whiteboards in her office.
No additional information regarding the break-in itself or the numbers found written on the whiteboard has been released.
The trial for these three students is scheduled for Nov. 5, with jury selection taking place on Nov. 4. The trial will be open to the student body, and a schedule has been released.
No word has been received from either Smith’s husband, or the University, regarding Smith’s death, or the new charges placed against the students.
